نطاق الحماية القانونية للعقار الغابي في ظل القانون 84/12 المؤرخ في 17 يونيو 1984 المتضمن النظام العام للغابات

Abstract

من خلال هذا المقال حاولت تسليط الضوء بإيجاز على نطاق الحماية القانونية التي أوردها المشرع الجزائري للعقار الغابي في ظل القانون 84/12 المؤرخ في 17 يونيو 1984 المتضمن النظام العام للغابات، ولذلك للأهمية البالغة التي يكتسيها هذا الموضوع في شتى المجالات، باعتبار أن الغابة تعتبر من مصادر الدخل القومي لما تمنحه من ثروة حيوية هائلة كالخشب والفلين وبعض الثمار، ناهيك عن فوائدها الاخرى وما تلعبه من دور جد هام في منع الانجراف والتصحر والمساهمة في ايجاد تنوع بيئي وطبيعي ثري وغني بمختلف الاشجار ومنح غاز الاكسجين والتقليل من تلويث البيئة وحمايتها وإعطاء نسق ومنظر جمالي بمناظرها الخلابة. فبدأت المقال بمحور تمهيدي ومفاهيمي، أبرزت فيه المقصود بالعقار بوجه عام، ثم المقصود بالغابة، إلى أن وصلت إلى ربط المصطلحين وتحديد مفهوم العقار الغابي وفقا للفقه والتشريع. في المحور الثاني وقفت على الباب الثاني من القانون 84/02 والذي هو تحت عنوان حماية الثروة الغابية، أين أبرزت مجال هذه الحماية والتي حصرها المشرع في: تعرية الأرض، الرعي في الاملاك الغابية، الحماية من الحرائق والامراض، البناء في الاملاك الغابية أو بالقرب منها، استخراج المواد، استغلال الاملاك الغابية. فحاولت دراسة وتحليل هذه المجالات الستة 6 طبقا لما جاء به التشريع في القانون 84/12. Through this article I attempted to shed light on the field of legal protection given by the Algerian legislator of the property in the forest under the law 84/12, dated June 17, 1984 containing the general system of forests because of the great importance of this topic in various areas, the forest is one of the national sources income to give the wealth of vital enormous timber and cork and some fruit, not to mention the benefits of the other and what role they are playing a very important role in preventing erosion and desertification and contribute to a variety of environmental and natural wealthy and rich with various trees and granting of oxygen gas and reduce pollution of the environment and protect it and give the layout and aesthetic view of the picturesque scenery The article began a preliminary and conceptual axis a, outlining the intended real estate in general, then the forest meaning, until I got to connect these two terms and define the concept of forest property , according to jurisprudence and legislation. In the second axis I studied the second chapter of the law law 84/12, which is: the protection of forest wealth, highlighted the area where this protection and which restrict the legislator in: stripping the land, grazing property in the forest, fire protection and diseases, construction of property in forest or near, materials extraction, exploitation of forest property. I tried to study and analyze these 6 six areas, according to the legislation came in the law 84/12
