مدى حجية التعبير بالإيجاب والقبول بين غائبين في عقد الزواج المبرم عبر وسائل الاتصال الإلكترونية غير المرئية

Abstract

لقد شهد العالم في الآونة الأخيرة تطورا هائلا في وسائل الاتصال، ما أدى إلى تطور الحياة وانتشار ما يعرف بثورة تكنولوجيا المعلومات، التي أضحت جزءا لا يتجزأ من حياة الإنسان، يستخدمها في أدق العلاقات الاجتماعية، ولذلك بات من المسلم به تصور إجراء واستخدام هذه الوسائل حتى في مجال عقد الزواج، حيث يتم التعبير عن الإرادة بتبادل الإيجاب والقبول عن طريق البريد الإلكتروني مثلا أو عن طريق التلكس أو الفاكس... وانطلاقا من ذلك وبسبب البعد المادي بين الأطراف المتعاقدة في مثل هكذا حالات، إذ يفترض أن أحدهما أو كلاهما غير حاضر في مجلس العقد، مما ينعكس بدوره على طبيعة كل من الإيجاب والقبول المشكلين لركن التراضي في عقد الزواج، حيث أصبح هذا الأخير يتميز بخصوصيات أثرت كثيرا على المفاهيم التقليدية السائدة في هذا الخصوص. وقد تناولت الدراسة آراء فقهاء الشريعة الإسلامية وموقف المشرع الجزائري مـن هـذه المسألة، بتبيان طبيعة التعبير عن الايجاب والقبول بين غائبين في عقد الزواج في الفقه الاسلامي والقانون الجزائري، كما تناولت حكم وحجية التعبير عن الايجاب والقبول بين غائبين عبر وسائل الاتصال الالكترونية غير المرئية عند فقهاء الشريعة الاسلامية والقانون الجزائري، وقد توصل الباحث إلى أن المشرع الجزائري في قانون الأسرة الجزائري لم يشر إلى هذه المسـألة وإن كانت نصوصه تشير ضمنا لجواز ذلك، وتركهـا للراجح من رأي الفقه الإسلامي مع ترجيح كفة مذهب الإمام أبي حنيفه، ولذا يوصي الباحـث بإعـادة النظـر في قانون الأسرة الجزائري، وإدخال النصوص الملائمة لمثل هذه العقود في تشريعاتها بإباحة هذا النوع من العقود إذا كان مستوفيا للشروط الشرعية، أو منعه إذا كان مخالفاً لنصـوص الشريعة.
