الفصل بين قانون اللجوء إلى الحرب (JUS AD BELLUM) و قانون الحرب JUS IN BELLO)) كضمانة لحماية المدنيين في النزاعات المسلحة الدولية

Abstract

يميز القانون الدولي المعاصر بين الأسبابالتي تجيز اللجوء إلى الحرب والنظام القانوني الذي يحكم سير النزاع المسلح الدولي ذاته عن طريق الفصل بين الأولى والثانية. ومؤدى ذلك أنه مهما كانت عدالة الغاية الدافعة إلى شن الحرب فان الأطراف المتحاربة تعامل على قدم المساواة من ناحية الالتزام بالقواعد الناظمة للنزاع المسلح ومن دون التمييز بين الطرف المعتدي والطرف المعتدى عليه.ويكتسي هذا الفصل أهمية بالغة في حماية المدنيين في النزاعات المسلحة عن طريق ضمان تنفيذ المبادئ التي تحكم سير العمليات العدائية كمبدأ حصانة المدنيين ومبدأ التناسب ومبدأ الضرورة .Contemporary international law distinguishes between the grounds upon which resort to war and the legal regime governing the conduct of international armed conflictitself, by separating the first and the second. And it means that, whatever the just end, driving to go to war, the belligerent parties are treated on an equal basis of compliance with the rules governing armed conflict and without distinction between the aggressor party and the victim of aggression. This separation is of great importance to the protection of civilians in armed conflict by ensuring the implementation of the principles governing the conduct of hostilities as a principle of civilian immunity and the principle of proportionality and the principle of necessity.
