Abstract

يعيش عصرنا الحاضر تسارعا مذهلا في مجال التكنولوجيا والعولمة، وعلى الرغم من الإيجابيات التي أحرزتها الوسائل التقنية فإنها لا تخلو من السلبيات، ولعل من أبرزها ظهور الجرائم المعلوماتية التي تختلف باختلاف مجالات ارتكابها، كالتصنت وإتلاف المعلومات والسرقة المعلوماتية وإجراء التحويلات المصرفية بطرق غير مشروعة، وذلك باستخدام الحاسب الآلي والإنترنت إضافة إلى ارتكاب الجرائم المخلة بالآداب والأخلاق العامة، التي تتخذ عدة صور منها إشاعة الفاحشة عن طريق إنشاء موقع أو نشر معلومات مخلة بالآداب العامة، ونظرا لخصوصية هذا النوع من الجرائم فقد أقدمت كل من التشريعات الداخلية والعالمية إلى إضفاء حماية تشريعية جنائية ملائمة لجرائم المعلوماتية.our present time is witnessing a dramatic acceleration in the field of technology and globalization, and despite of the positive which made by the technical means, are not without the negatives and perhaps the most prominent of the emergence of information crimes which differ in different areas of commission such as eavesdropping data destruction of information theft and bank wire transfers in illegal ways using the computer and the Internet In addition committing crimes against morals and public, which take several photos of them, rumor of absences by creating website or publishing information against public morals , and due to privacy of this type of crimes ,it has introduced each of Internal and international legislation to add appropriate criminal legislative protection for cybercrime.
