Abstract

مسؤولية الشخص المعنوي لطالما كانت محل جدل واسع لكن انتهى ذلك بتقريرها ووضع الجزاءات المناسبة لها وهو ما أخذ به المشرع الجزائري وانعكس في مختلف القوانين، حيث أن هذه الأخيرة وفي إطار أنشطتها أو قيامها بمهامها من قبل أعضائها أو ممثليها أو لحسابها الخاص قد ترتكب أفعالا تعد جرائم معاقب عليها في نظر المشرع، مما يجعلها تقع تحت طائلة المسؤولية الجزائية والجزاءات التي يقرها القانون التي تختلف بين الحبس والغرامات بالنسبة للممثلين الشرعيين للشخص المعنوي وغرامات وعقوبات تكميلية بالنسبة للمصارف فجاءت هذه العقوبات مشددة نظرا لخطورتها وعلاقتها بالاقتصاد الوطني والسير الحسن للمنظومة المصرفية والمالية.The responsibility of the legal person has always been the subject of a wide debate, but this has ended after its realization is the setting of the appropriate sanctions, and what is taken by the Algerian legislator, and reflected in the various laws, , since the banks and in the course of their activitiesand performance of their duties by its members or its legitimate representatives, or on its own behalf, may commit acts considered as crimes punishable by the legislature, which the subject to criminal liability is the criminal sanctions approved by law. this responsibility and impose penalties between imprisonment and almonds for the legitimate representatives of the legal person, and fines, additional sanctions for banks, these penalties are severe because of its seriousness and its relationship to the national economy and the proper functioning of the banking and financial system.
