السلطة القمعيـة لمجلس المنافسـة بيـن حمايـة المنافسة الحرة وضبط حرية المبادرة

Abstract

لقد صاحب انتقال الدولة إلى اقتصاد السوق استحداث آليات جديدة تتمثل في السلطات الإدارية المستقلة، حيث يعتبر مجلس المنافسة أحد هذه السلطات، وقد خوله المشرع مجموعة من الصلاحيات أهمها السلطة القمعية وذلك من أجل ضبط السوق وحماية المنافسة، لذلك فإن هذه الدراسة تهدف لتناول إشكالية ممارسة مجلس المنافسة للسلطة العقابية، وبالتالي تجاوز المبدأ التقليدي الذي يقضي بالاختصاص الاستئثاري للقضاء في مجال الردع وقد خلصت الدراسة إلى أن هذا الإشكال تم تجاوزه بالاعتراف لمجلس المنافسة بسلطة الجزاء والقمع، باعتباره يتصرف في نطاق ما يتمتع به من امتيازات السلطة العامة وفي حدود خضوع كل ما يصدر عنه للضمانات القانونية والقضائية؛ مما يكفل الحفاظ على الحقوق والحريات الأساسية المضمونة دستوريا. The State's transition to a market economy has been accompanied by the creation of new mechanisms which are the independent administrative authorities. The Competition Council is one of these authorities. The legislator has given it a set of powers (Privileges) , the most important one of them is the repressive authority in order to control the market and protect the competition. Therefore, this study aims to deal with the Council as it acts within the scope of its public authority privileges and within the scope of all the legal and judicial guarantees which insure the preservation of the basic rights and freedoms that are constitutionally guaranteed.
