دور التشـريــع فـي تحسيـن السلامــة المـروريــة

Abstract

في ظل التصاعد الخطير لحوادث المرور بالجزائر وحصيلتها المأسأوية فقد أولى المشرع الجزائري على غرار غيره من التشريعات أهمية بالغة لحوادث المرور نظرا لخطورتها وما بنجم عنها يوميا من خسائر فادحة سواء المادية منها أو البشرية وما يترتب عن ذلك من آثار اجتماعية واقتصادية على الفرد والمجتمع لذا استوجب الأمر توفير حماية قانونية سواء أكانت قبلية تتمثل في التشريعات الردعية للتقليص والتقليل من حوادث المرور وحماية مستعملي الطرقات من المخاطر الناجمة عنها وهو ما جاء به الأمر 01/04 المتعلق بتنظيم حركة المرور عبر الطرق وسلامتها وأمنها المعدل والمتمم بالقانون 04/16 المعدل والمتمم بالأمر 09/03، وسواء أكانت هذه التشريعات بعد وقوع حادث المرور والتي يهدف من خلالها المشرع الجزائري إلى حماية ضحايا هذه الحوادث أو ذوي حقوقهم .In light of the serious escalation of traffic accidents in algeria and its tragic consequences, the algerian legislator, like other legislations, has attached great importance to traffic accidents because of the gravity and daily consequences of heavy losses, both material and human, and the consequent social and economic effects on the individual and society.
