مدى فاعلية الآليات القانونية في ترسيخ نزاهة القضاة

Abstract

تهدف هذه الورقة العلمية إلى التعرف عن الفساد القضائي، ومحاولة بيان أسبابه والكشف عن الآثار الوخيمة التي تترتب عنه، كما تم التطرق إلى مدى فاعلية الآليات القانونية التي وضعها المشرع للتخفيف من هذه الظاهرة، سواء تعلق الأمر بالآليات الوقائية كمدونات أخلاقيات المهنة القضائية وكذا آلية التصريح بالممتلكات، أو الآليات العلاجية والمتمثلة في مساءلة القضاة عن تقصيرهم وإخلالهم تأديبيا وجزائيا، حيث تم التوصل إلى أن الآليات القانونية لوحدها غير كافية لمجابهة هذه الظاهرة، لذا يتعين مشاركة جميع الفاعليين سواء رسميين أو غير رسميين في الكشف عن جرائم الفساد المرتكبة من طرف القضاة.This paper aims to identify judicial corruption, and tries to explain its causes and to uncover the serious consequences that result from it, The effectiveness of the legal mechanisms established by the legislator to alleviate this phenomenon was also discussed, whether it's about the preventing mechanisms like the codes of ethics of the judicial work and also the mechanism of declaring propereties, or the treating mechanisms represented in holding judges accountable for their failure and punishing them for any disciplinary breach, as it was concluded that the judicial mechanisms alone are not enough to face the discussed phenomenon, so the participation of all actors both official and non-official is necessary to solve the crimes of corruption committed by judges.
