اعتبارُ المقاصدِ في الاجتهادِ المعاصرِ عند الشيخِ مُحَمَّد عِزّ الدِّين عَبَّاسِي

Abstract

يَهْدِفُ هَذَا البَحْثُ إِلَى تَجْلِيَةِ أَثَرِ المَقَاصِدِ الشَّرعيَّةِ فِي فَتَاوَى وَآرَاءِ الشَّيْخ محمَّد عِزِّ الدِّين عَبَّاسِي، وَذَلِكَ مِنْ خِلَالِ دِرَاسَةٍ لِبَعْضِ اجْتِهَادَاتِهِ الـمُدَوَّنَةِ فِي مُصَنَّفِهِ المَوْسُومِ بـ: "تُحْفَة السَّالِكِ إلى خَيْرِ المَسَالِكِ"، وَهوَ ما دعاني بدورِهِ إلى صِياغَةِ الإِشْكَاليَّة الرَّئِيسِيَّةِ عَلَى النَّحْوِ الآتِي: "مَا مَدَى اعْتِبَار الـمَقَاصِدِ الشَّرْعِيَةِ فِي فَتَاوَى النَّوَازِلِ الفِقْهِيَةِ عِنْدَ الشَّيْخ مُحَمَّد عِزّ الدِّين عَبَّاسِي؟" وَتَكْمُنُ أَهَمِيَّةُ البَحْثِ فِي ارْتِبَاطِهِ بِأَحَدِ أَهَمِّ مَعَالِمِ النَّظَرِ الشَّرْعِيِّ قَدِيماً وَحَدِيثاً، وَالَّذِي ظَهَرَ الاهْتِمَامُ بِهِ بِشَكْلٍ أَوْسَعَ فِي العُقُودِ الأَخِيرَةِ، أَلَا وَهُوَ: "مَقَاصِدُ الشَّرِيعَةِ الإِسْلَامِيَّةِ"؛ إِذْ يُعَدُّ مِنَ الـمَسَالِكِ الاجْتِهَادِيَةِ الدَّقِيقَةِ. بِالإِضَافَةِ إِلَى ذَلِكَ تَعَلُّقُ الدِّرَاسَةِ بِأَحَدِ أَبْرَزِ فُقَهَاءِ وِلَايَةِ وَادِي سُوف المعاصرينَ، وَهُوَ فَضِيلَةِ الشَّيْخ "محمَّد عِزّ الدِّين عَبَّاسِي". ومن أهمِّ النتائجِ الّتي توصَّلَ إليها الباحثُ أنَّ هناكَ حضوراً لافتاً لمقاصدِ الشَّريعةِ في كثيرٍ منَ الفتَاوَى والآراءِ الَّتي اجتهدَ فيها الشَّيْخ، بالإضافةِ إلى وُجوبِ إعادةِ النَّظرِ والتَّمحيصِ لتُراثِ الشَّيْخ لِيُستفادَ منهُ في هذَا الجانبِ، وفي جوانبَ أُخرَى متعلقةٌ بالاجتهادِ والفَتوَى. This study aims to clarify the effect of Sharia’s purposes in Fatwa of Sheik Mohamed Ezzeddine Abbassi, through a survey of his opinions in the book entitled “Tohfat Essalek Ela Kheir Elmasalek“ . This prompted me to formulate the main issue as follows: To what extent are Sharia’s purposes considered in Fatwa of Sheik Ezzeddine Abbassi. The importance of research lies on its link with one of the most important features of Sharia, which is the purposes of Sharia, in the past and present. However, the interest to this issue has been increased in recent decades. The current subject is considered as one of the precise ways in Ijtihad of the scholars. Additionally, the study is related to one of the prominent scholar in Eloued city, who is Sheik Ezzeddine Abbassi. The most important findings reached by the researcher is that there is a significant presence of the purposes of Sharia in Fatwa of Sheik Abbassi. Besides, it’s high time to review and examine the heritage of Sheik so as to get benefit from it.
