التدخل الدولي و ضمانات الإلتزام الدولي بإحترام حقوق الإنسان

Abstract

إذا كانت الضمانات الدولية لحقوق الإنسان والتي قررتها المواثيق والاتفاقيات الدولية ذات الصلة، ومنها إمكان تدخل المجتمع الدولي لكفالة الاحترام الواجب لهذه الحقوق، قد ظلت كمبدأ عام بعيدة عن التطبيق الفعلي خلال العقود الأولى من حياة الأمم المتحدة، إلا أن هذه الضمانة الخاصة بالتدخل الدولي "الإنساني" قد أضحت ولاعتبارات سياسية بالدرجة الأولى، على قائمة الإجراءات التي يتم اللجوء إليها لفرض مثل هذا الاحترام. فالتزايد المطرد في تطبيقات التدخل الدولي الموصوف بالإنساني أو المتذرع بأغراض إنسانية، لا يفسر فقط في ضوء تعاظم الاهتمام الدولي بقضايا حقوق الإنسان، بل إن التطورات غير المسبوقة على مستوى طبيعة النظام الدولي، والتي حولته من مجتمع الدول ليصبح مجتمعا دوليا بإرادة ذاتية مستقلة، إرادة أضحت مصدرا من مصادر الالتزام في نطاق العلاقات الدولية المعاصرة، كان لها كبير الأثر على تطبيقات التدخل الدولي الإنساني من خلال ممارسات الأمم المتحدة، ما ساهم بدوره في تراجع مضمون مبدأ السيادة الوطنية ونطاق تطبيقه لصالح مبدأ المحاسبية الدولية، أو حتى البحث عن مفهوم جديد لهذه السيادة يأخذ بعين الاعتبار حقيقة أن التطورات السابقة قد قيدت حرية الدولة وبشكل يجعلها أقرب إلى وضع الفرد في القانون الداخلي، وذلك من حيث الخضوع لأحكام القانون وعدم القدرة على التهرب من الالتزامات المترتبة عليها، سواء لصالح الدول الأخرى أو حتى لصالح مواطنيها. وبحيث يمكننا القول أن الدوافع الإنسانية كانت القاسم المشترك لتبرير الكثير من التدخلات، إلا أن خبرة العمل الدولي يكشف على أن ثمة دوافع و أهداف معلنة لهذا النوع من التدخل، هي التي تسوغ في نهاية الأمر مشروعيته. هذه أهم الإشكالات التي تواجه عمليات التدخل الدولي الإنساني، والتي يمكن تصنيفها في إشكالات تتعلق بالأولويات، وأخرى بالوسائل التي يمكن أن تتم بها، وثالثة تتعلق بالنتائج أو الإنجازات. هذا ما حاولت الرسالة الإلمام به، معتمدة في توضيح هذه القضايا نموذج ليبيا. The international guaranties of human rights which was announced by the charters and the international treaties based on the possibility intervention of international community to respect and protect these rights. But the fact that these targets have been stay far from the real practice especially in the first decades in the work of the united nation. But for political aspects this guaranty which relate to the human international intervention , became at more important in the procedures which was taken to oppose such a protect. The increase or the spread of the applications of international intervention which is so called human intervention does not mean the great value of the human aspect , But the development at the level of the nature of the international order which changed into international community with a subjective and independent will of state. This later became one of the sources of international adherence strictly in the fielded of the contemporary international relation , Which has great influence on the applications of the human international intervention from deferent practices and activities of the united nation. This contributed in the decrease of general comprehension of the principle of the national sovereignty and the limits of her applications in the international penalty or even looking for a new concept to such a sovereignty taking into consideration the fact of the previous development which restricted the freedom of states , as similar as to a person or an individual who has been adhered to the internal low , By adhering to the judgments of the low and incapacity to release from the regulations and the adherence which related on it , whether for other states or even for their populations. Finally , we can to say that the human dimension was introduced by many states to justify many intervention , But the fact that there are other reasons which gave at the end , the legitimacy of such kind of intervention. This is one of the most important tasks which face the operations of the human international intervention , and this problem is related with the priorities and tools introduced , and others are related with the results or the action. This is what this thesis is attempt to arrive to it ntroduced by using the sample of the state of Libya
